If you were not driving the vehicle at the time of the offence, you can nominate the driver who was. The fine will then be withdrawn and issued to the person responsible.
I have been nominated as the driver responsible for a traffic offence, but I was not driving at the time. What can I do?
If you have been nominated for a traffic offence but you were not driving the vehicle at the time, you can nominate the driver who was.
Do not pay the fine, as it will be withdrawn and issued to the driver you nominate. It is important to nominate the driver responsible before the due date on the fine to avoid late payment fees and escalation of the matter to an enforcement order or infringement warrant.

I've received a fine and need to nominate another driver, but I don't live in Victoria. What can I do?
If you don't live in Victoria, you can still nominate the driver responsible by returning a nomination statement by fax or post.

What if I didn't receive the fine in time to nominate another driver?
You can nominate another driver if your fine is still at the infringement notice or penalty reminder notice stage of the infringements process.
If the matter has escalated to an enforcement order of infringement warrant you must first apply to the Infringements Court to have the order or warrant cancelled before you can nominate another driver. If your application is unsuccessful, you will remain liable to pay the fine and any additional fees.

Excessive speed offences
If you received a fine for an excessive speed offence (25km/hr or more over the speed limit or 130km/hr or more if the speed limit is 110km/hr), you can only nominate another driver within 28 days of the date on your fine.
If you do not nominate another driver within this period, you are liable to pay the fine and your driver licence will be cancelled or suspended.
If you only became aware of the fine after the 28 day period expired, you can apply to the Infringements Court for more time to deal with the fine.
What happens if the vehicle involved in a traffic offence is registered to a company?
If a vehicle involved in the traffic offence is registered to a company, the company will receive the fine.
The company must then nominate the driver responsible for the offence. The fine will then be withdrawn and issued to that driver.
Nominating the driver
For infringements by speed or red light camera
Privately owned vehicle
Traffic infringements are issued to the registered vehicle owner in the first instance. If the owner was not the driver at the time of the offence, or the vehicle was sold prior to the offence, the owner has 28 days from the issue date of the 'Infringement Notice' to nominate and supply details of the driver or person in charge. The owner should complete the statement ' Part 'F' on the infringement notice, with the full correct details (name, date of birth and current address) of the driver or person in charge at the time of the offence and mail it to:

When returning information it must be accompanied with the original Infringement Notice.
If the nomination is not received by Police at Infringement Management and Operations within the 28 days then the owner is presumed to be the driver and liable to pay the fine and incur the demerit points. Once a nomination is received then Police will issue a new infringement to that person who is then subject to the same requirement as outlined above.
If you have received a Final Demand Notice and you were not the driver, DO NOT pay the traffic infringement notice, please complete the Part F and forward the notice with the full details of the driver as above. Another infringement notice will be issued to the nominated driver or person in charge.
NOTE: It is important that the person named on the infringement completes the process themselves. Read the infringement notice thoroughly and if uncertain of your obligations then contact Infringement Management & Operations on (08) 9374 4555 for advice.
If the infringement is paid in error and a fraud has not been committed in relation to the payment, then the person named on the notice has no recourse for the matter to be overturned.
Business owned vehicle
The responsible person for a business owned vehicle will receive a 'Notice Requesting Information' (NRI). This NRI is not an infringement in the first instance but a request to supply details of the driver or person in charge of a vehicle at the time of an alleged offence. The business must complete Division 1 "Driver or person in charge - known" on the NRI, with the full correct details (name, date of birth and current address) of the driver or person in charge at the time of the offence and mail it to:

Once the nominated driver or person in charge details are received then that person will be posted an infringement notice which is a modified penalty to that endorsed on the NRI. That person is then subject to the same requirement as outlined in Individual owned vehicle.
